General Information
• Speeds are represented in downstream/upstream format, e.g. 256kbit / 64kbit represents up to 256 kilobits per second (kbps) downstream / 64kbps upstream. The downstream/upstream speeds refer to the maximum speed capable; ISPX does not guarantee that these speeds will be achieved. The actual speed that will be achieved is likely to be less than the maximum speed capable because of dimensioning, overheads, and other technical reasons.
• Uploaded data (data sent to the Internet) will not be counted.
• For the purposes of calculating usage, 1GB = 1000 megabytes (MB).
• Unused download allowance cannot be rolled over into subsequent months.
• Plan changes and cancellations must be advised in writing to ISPX prior to the end of any billing period (calendar month) and will become effective as of the 1st of the following month.
Terms & Conditions for ADSL Services
1. The Service
The provider will provide the Internet broadband and any other services nominated to you. In order to receive the service you must satisfactorily complete the Application Form (you must be legally eligible to do so). ispX reserve the right to amend our terms and conditions at any time.
2. Acceptable Use Policy & General Terms and Conditions
You agree to comply with ispX’s Acceptable Use Policy, and the Standard Form of Agreement as outlined in the ispX General Terms and Conditions document. The content of this document forms part of the terms and conditions of service. You agree and acknowledge that ispX may exercise any rights as specified in the ispX General Terms and Conditions.
3. Disclaimer
We accept no responsibility for any loss or damage arising directly or indirectly from the use of the facilities or services. We make no warranty regarding the facilities or their suitability for any particular purpose. We are in no way responsible for any telecommunication charges or any other charges the user may incur in using the service. You agree and acknowledge that the broadband service is provided without warranty that it is continuous or fault-free. Subject to law, we are not liable for any loss or disappointment you may suffer as a result of any faults or interruptions in the broadband service.
4. Contract Period
All ispX ADSL services commence with an initial contract period whereupon the completion of that period the contract reverts to an ongoing one month contract. For all ADSL services the initial contract period is 6 months. There is a cancellation fee associated with termination of services by the customer prior to the completion of the nominated initial contract period. REFER to specific details in the Cancellation clause.
5. Provider Rights
The provider reserves the right to: a) Monitor your use of the service at all times b) Accept or reject an application for the provision of Internet access for any reason c) Cancel a user’s account at any time for any just reason on the giving of notice to the user and a refund of the subscription fee on a pro-rata basis d) Change any rates or fees at any time outside the contracted period.
6. Payment of Fees
The initial connection and subscription fee MUST accompany this Application Form. (The initial connection fee is non-refundable.) Where this initial payment is by cheque then the application process will begin once the funds are deemed to be cleared by ispX. Subsequent subscription fees must be paid when invoiced electronically to the nominated e-mail address. The invoice shall be sent to the user by e-mail, and the invoice shall be deemed to have been received at 9:00am the day after the timestamp on the e-mail. The user must pay to the provider the agreed subscription fee by the close of business hours 7 days from receiving the invoice (the “Due Date”). The provider may cancel the user’s account if not paid by Due Date. The provider reserves the right to take any legal action to recover any unpaid fees owing after cancellation of f
the user’s account. ALL PRICES QUOTED ON THIS APPLICATION FORM ARE INCLUSIVE OF GST.
7. Payment by Personal Cheque
Where the user chooses to make payment for the service by personal cheque then they must endeavour to deliver the cheque to ispX at least 3 days prior to the invoice Due Date in order to allow time for the cheque funds to clear. Where a personal cheque arrives at ispX on or after the invoice Due Date the account is deemed to be in arrears until the cheque funds have been cleared by ispX’s bank.
8. Moving / Relocation
A moving location fee of $110 will apply to any customer who requests their ADSL service be moved to another location or to another phone line.
9. Change of Speed
A service fee of $55 will apply to any customer who requests their current ADSL service be exchanged for an ADSL service of a different speed. Where this is a change to a lower or higher priced service that occurs in the middle of a subscription period then a pro-rata amount for the current month will be calculated and applied as a credit or debit to the new service.
10. Shaping
Where you exceed the nominated monthly download limit for the service then your link speed may be reduced to 64kb.
11. Your Information
The provider will not disclose any information given to us for the purposes of applying for an account to any other person other than necessary for the provision of the service. The provider reserves the right to give such information and any other information to the State or Federal Police or relevant Government authority where we have been properly subpoenaed or compelled by law to give such details.
12. Breach / Cancellation
Cancellation of the service requires a written notice advising of the cancellation 30 days in advance of the requested cancellation date. Cancellation of all ADSL services prior to 6 months will result in a $60 cancellation fee.
